Granting Bail to Madzibaba Ishmael Sends a Dangerous Message to Survivors…

The recent decision by the High Court to grant bail pending appeal to controversial religious leader Madzibaba Ishmael in a rape case has left many women’s rights defenders deeply concerned.

While courts must uphold due process and the right to appeal, decisions of this magnitude must also consider the broader impact on survivors of sexual violence and the public’s confidence in justice.

Rape is not an ordinary offence. It is a grave violation of bodily autonomy, dignity and human rights. When someone convicted and sentenced to 20 years for such a crime is released on bail shortly after conviction, it sends a troubling message to survivors who already struggle to come forward. Many women and girls remain silent due to fear, stigma and intimidation. Seeing a powerful religious leader regain his freedom may reinforce the belief that justice is beyond their reach.

Cases involving religious figures also carry a unique dimension of power and influence. Leaders of spiritual movements often command loyalty from followers, which can create an environment where victims feel pressured to withdraw complaints or alter testimony. In such circumstances, courts should exercise extreme caution before granting bail, especially when the alleged victim is young and the case has drawn significant public attention.

Zimbabwe has made commitments to combat gender-based violence and protect women and girls. Upholding these commitments requires a justice system that not only follows the law but also demonstrates sensitivity to the realities survivors face.

Granting bail in cases of serious sexual offences risks weakening public confidence in the fight against gender-based violence. Justice must not only be done it must be seen to stand firmly with survivors.
