Harare– A legal bid to interdict operations at a contested mining site crumbled in the High Court on [Day/Date], after the applicant conceded that the matter had been rendered redundant by subsequent court rulings.

The urgent chamber application, filed under Case Number HCH976/26 by Navid Incorporated (Private) Limited—an agent of Freda Rebecca Gold Mine represented by Ronald Chisvo—sought to halt activities in areas including Morrocco, Headgear, and Gwiringwindi, which fall under the broader ambit of Mining Lease 21.

However, when the matter was brought before Justice Muremba, the Court indicated that the application had been overtaken by events. Later court orders and proceedings had already addressed the issues raised, altering the legal landscape regarding possession and operational rights in the area.

Following the Court’s guidance, counsel for the applicant formally withdrew the application. Legal observers noted that continuing the matter would have served no practical purpose, as the remedy sought was no longer procedurally appropriate.

The withdrawal effectively confirms that the application no longer stands as a viable legal remedy, particularly given that the High Court has previously pronounced itself in favor of the lawful operator, Side Electrical (Private) Limited, trading as Botha Gold Mine.

‘Pattern of Disruption’

Industry sources have characterized the abandoned application as the latest in a series of unsuccessful legal maneuvers directed at Botha Gold Mine. Sources describe the efforts, often linked to Mrs. Angel Mpofu-Chisvo, as frivolous and factually inconsistent.

“It is part of an ongoing campaign aimed at disrupting lawful mining activities,” one observer noted, suggesting that the litigation is being used to settle personal grievances outside of legal frameworks.

Political Allegations Surface

Compounding the commercial dispute are allegations regarding the identity being leveraged by one of the claimants. Sources within political and mining circles allege that Mrs. Chisvo has at times attempted to present herself as the daughter of senior ZANU-PF leader Cde. Obert Mpofu to lend political weight to her actions.

These representations have been disputed, with observers warning that invoking political figures in private disputes risks misleading the public and politicizing matters that are fundamentally commercial.

Mine Operations Continue

Management at Botha Gold Mine has confirmed that normal mining operations are continuing uninterrupted. The company has reiterated its commitment to resolving disputes strictly through lawful processes while prioritizing the safety of workers.

Authorities have confirmed that the Zimbabwe Republic Police remain capable of maintaining order, and any acts of violence or unlawful interference with operations will be dealt with through normal legal channels.
